These Terms of Service (hereinafter referred to as the “Terms”) constitute a legally binding agreement between you and the SpeedMaster developers governing your downloading, installation, access, and use of our mobile application (hereinafter referred to as the “App”) on your iPhone within the United States. By downloading, installing, or using this App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, please do not use this App. These Terms and our Privacy Policy together constitute a legally binding agreement between you and us.

2. Eligibility

You must be 13 years of age or older (or the legal minimum age in your jurisdiction) to use this App. By using this App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement. We do not knowingly collect personal information from children under the age of 13.

3. License Granted

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to:

- Download, install, and use this application on your iPhone.

- Use this application solely for your personal, non-commercial purposes.

4. Restrictions

You agree not to:

- Copy, modify, or create derivative works of this application.

- Reverse engineer, decompile, or attempt to extract the source code of this application.

- Remove, alter, or obscure any proprietary notices in this application.

- Use this application for any illegal purpose or in violation of any local, state, national, or international law (including applicable data protection regulations).

- Use this application to infringe the intellectual property rights of others.

- Share, sell, rent, or lease this application to any third party.

- Attempt to access, collect, or use any data processed by the application in any manner inconsistent with this Privacy Policy or these Terms.

5. Application Functions

5.1 Network Speed Test

This application provides a network speed test function for reference only. Test results may vary depending on network conditions, device performance, and other factors. We do not guarantee the accuracy of speed test results. All network data generated during the speed test is used only for metric calculation and will not be stored, recorded, or transmitted to our servers or third parties.

5.2 Smart Photo Management

This application's photo management function is designed to help you organize your local photo library. All processing is done locally on your device. You are responsible for:

- Backing up photos before using the organization function.

- Confirming whether the application's suggested actions meet your needs.

- Making the final decision on whether to delete or keep any photos.

5.3 Similar and Duplicate Photo Cleanup

This application provides a similar and duplicate photo cleanup function to help you delete redundant image files and optimize your device's storage space. Key features of this function:

- All similar/duplicate photo identification and comparison are done locally on your iPhone. No image content, comparison results, or related data are uploaded to external servers or shared with third parties.

- We are not responsible for any data loss resulting from the use of the cleanup function. We strongly recommend that you back up important photos before using this function.

5.4 Video and Photo Compression

This application provides video and photo compression to optimize device storage. All compression processing is done locally on your iPhone. Original video and photo files will not be modified or overwritten without your explicit consent, and compressed files will not be uploaded to any external servers or shared with third parties.

5.5 Permissions

This application will only request specific permissions on your device to enable its core functions. All processing is done locally on your device whenever possible.

Network Access Permissions

- Purpose: This permission is only used for network speed testing to measure your internet connection's upload speed, download speed, and latency.

- Data Processing: Network packets sent and received during the test are only used to calculate speed and latency metrics. This data will not be stored, logged, or transmitted to our servers or any third party. This network activity will not obtain or associate any personal information.

Personal Information.

Photo Library Access

- Purpose: This permission is used for intelligent photo management, similar/duplicate photo cleanup, video/photo compression, and related photo/video organization functions in your device's local gallery.

- Data Processing: All photos and videos (including portrait classification, similar/duplicate identification, and compression) are processed locally on your device. No photo/video content, thumbnails, metadata, comparison results, or compressed files are uploaded, transmitted, or shared to our servers or any third-party services. Portrait classification uses on-device intelligent technology and does not involve facial recognition or facial data collection.

6. User Responsibilities

You are responsible for:

- Maintaining the security of your device and iOS account.

- Complying with all applicable laws and regulations when using this application, including applicable data protection laws such as the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR).

- Always obtain permission from the relevant party before using photos or videos containing information about others.

- Before using the similar/duplicate photo cleanup or compression features, please back up important photo/video data. You are fully responsible for any data loss caused by improper operation.

- Please manage your application permissions through your iOS system settings and understand that revoking permissions may disable related functions (for example, revoking access to the photo library will disable photo management, similar/duplicate photo cleanup, and video/photo compression, but will not disable the network speed test function).

7. Privacy

Your use of this application is governed by our Privacy Policy. This policy explains how we collect, use, and protect limited non-personally identifiable information (such as device model, iOS version, and application usage data) to fix bugs and improve user experience. We do not collect personal information (such as name, email address, phone number), biometric data. By using this application, you agree to the terms set forth in our Privacy Policy.

8. Intellectual Property

This application (including its design, functionality, and content) is owned by us and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved. Third-party services integrated into this application (such as Firebase and AppsFlyer) retain their respective intellectual property rights, and your use of these services is subject to their respective terms.

9. Disclaimer

This application is provided "as is" and "as available." To the maximum extent permitted by applicable law, we expressly disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, accuracy, security, and non-infringement. We do not warrant that this application is error-free, uninterrupted, secure, or virus-free. We also do not warrant the accuracy of similar/duplicate photo identification results, nor the quality of compressed photos/videos. We do not warrant the security of local data stored on your device, as no electronic storage method is 100% secure.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of content, or loss of profits (including but not limited to damages caused by similar/duplicate photo cleanup errors, compression quality issues, or local data security incidents), arising out of or related to your use of or inability to use this application, even if we have been advised of the possibility of such damages. Our total liability (if any) shall not exceed the amount you paid (if any) for access to this application. This limitation applies regardless of the legal basis of the claim (e.g., contract, tort, negligence).

11. Data Storage and Security

All data generated by this application (e.g., speed test results, local photo organization tags, similar/duplicate photo identification records, compressed files) is stored solely on your personal device. We do not use external servers to collect user data for this application. We have taken administrative, technical, and organizational measures to protect data, but we cannot guarantee absolute security against unauthorized access, loss, or misuse.

12. Third-Party Services

This application may use third-party services, such as Firebase for analytics and AppsFlyer for performance tracking, to power its operation. These third-party services may collect limited anonymized device data and are subject to their respective privacy policies. We do not share any personal content, identifiers, photos, videos, similar/duplicate identification results, or compressed files with third-party services.

13. Termination

We may terminate or suspend your access to this application immediately without notice and without liability for any reason, including your breach of these Terms or Privacy Policy. Upon termination, your right to use this application will immediately cease, and you must stop using the application and remove it from your device.

Updated Terms will become effective upon posting within the application or on our website, and we will provide notice of changes as required by applicable law. Your continued use of this application after the posting of updated Terms constitutes your acceptance of the revised Terms. We recommend that you review these Terms periodically.

15. Applicable Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. This includes compliance with applicable data protection laws in applicable jurisdictions, such as the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR). Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state courts or federal courts in San Francisco County, California.

16. Fees

We offer both free and paid services. By subscribing to a paid service, you agree to pay the price quoted at the time of purchase (“Fees”). We may calculate taxes payable on you based on the billing information you provide at the time of purchase. You are responsible for all associated costs of using the purchased service (e.g., data traffic fees and currency exchange fees). You will pay Fees in the currency quoted at the time of purchase. Unless otherwise required by applicable law, we reserve the right to change the applicable currency at any time. We reserve the right to change prices at any time. However, if we have set a specific period and fee for your use of the service, that fee will be valid for that period.
